Vacation Rental Policies

 

 
 
 
IN GENERAL
Our rentals range from a rustic cabin on the lake to luxurious lakeside homes. Because all are individually owned, they are all equipped differently. Feel free to contact us so that we may answer any questions you may have regarding the specifics of your rental property.
 
Agency Disclosure
Century 21 Scenic Realty. serves as the agent and representative of all Owners of vacation properties in its rental program, and is acting at all times, in and for the best interests of the Owners.
 
  1. Making your Reservation
·        Decide how many people you need to accommodate and what dates you plan to visit.
·        Call us at (800) 997-4981  Mon. – Sat. from 9:00-5:00 and from 1:00-5:00 Sundays. Stop by our office at 3680 Hwy 76 and talk with someone on our reservation staff. For immediate assistance call Robbyn: (706) 781-9946.
 
     Advance Reservations
When reserving 30 days or more in advance, payment is required within 3 days from the date of making the reservation. The reservation deposit is ½ of the rental amount for a weekly reservation. For less than a week, full payment is required. If the payment is not received before the due date, your reservation is cancelled.  We ask that upon receipt of the VACATION RENTAL AGREEMENT, if you choose not to keep the reservation, please notify the office so we may re-rent the unit.
            Final Payment
Final payment is due in full 14 days prior to check-in; we accept , cash or credit cards for this payment. ALL MONIES WILL BE DEPOSITED INTO AN ESCROW ACCOUNT OF CENTURY 21 SCENIC REALTY at United Commumity Bank of Hiawassee. CENTURY 21 SCENIC REALTY may, from time to time, forward advance reservations payments (not to exceed 50% of the total rent). There is a $25 charge for all returned checks for non-sufficient funds or stop payment. 
Reservation Fee
There will be a $20 reservation fee applied to all reservations for processing and services. This item is NON-refundable under any circumstances including cancellations. This fee is non-negotiable.
Minimum Stay Requirements
All rentals normally require a minimum reservation of 2 nights; however, some exceptions apply. If you require a shorter stay, please ask for availability and rate.
 
Maximum Occupancy
The maximum number of guests per unit is based on the individual unit’s ability to comfortably and safely accommodate our guests. If maximum occupancy is exceeded you may be asked to vacate the property and forfeit any rental payments.
 
 
  1. Confirming your Reservation
    • Check-in at our office located at 3680 Hwy 76 between 4:00-5:00 PM (There may be exceptions to this).
    • Late check-ins may pick up their keys at an atlenative location to be detiremined on an individual basis. 
    • Tentative reservations for next year can be made anytime BEFORE your departure, with a $20 NON-refundable pre-booking fee. (Please do this during the week MONDAY-FRIDAY).
Cancellations
If you have to cancel your reservation your deposit will only be refunded if your unit is re-rented. If we re-rent the unit for the some period as your ORIGINAL reservation we will refund your advance deposit; less the $20 reservation fee, plush a $35.00 cancellation fee.
NO SHOW POLICY - The total amount of the reservation will be charged along
with a $30.00administration fee.
Rental Checks
A $25.00 service charge will be incurred for any returned checks
 
Taxes
Tax and Cleaning fees will be included in the final bill.
 
  1. Upon your Arrival
    • Check-in begins at 3:00 PM and if you are paid in full, you can take advantage of our speedy check-in service.
    • Late check-ins can make alternative arrangements.
Check in time/ Late Arrivals
Check in time is 4:00 PM or later. Please understand most units will be ready, but if there is a maintenance issue or something unforeseen, we will have the property available as soon as possible. When there is back to back reservations for a property occasionally it  will not be available until 5PM. PLEASE DO NOT GO TO THE RENTAL PROPERTY PRIOR TO CHECK IN AT OUR OFFICE, THIS WILL DELAY YOUR CHECK IN PROCESS. CLEANING CREWS WILL NOT ENTER A PROPERTY THAT APPEARS TO BE OCCUPIED. At check in time you will receive two keys and the necessary gate cards and parking passes.
  1. Departure
    • Check out is 11:00 AM at the Century 21 Scenic Realty office.
    • Please return all key packets to Century 21 Scenic Realty office and report any damages in writing. Include all keys in the packet. There is a charge for each item not returned.
    • Have a safe and pleasant trip home!
 
Departure Duties
Things for our guests to do:
·        Turn off ALL lights, set thermostat to 78 in summer and 55 in the winter
·        Return all furniture to its original location
·        Remove all food from cabinets and refrigerator
·        Wash dishes, pans, etc.
·        Remove dishes from dishwasher
·        Close and lock all windows and doors
·        Check closets, drawers, and under beds for personal belongings
·        Make all beds with spreads
·        There will be a charge if left excessively dirty
 
 
Check-Out Time
11:00 AM is check out time and is strictly enforced. PLEASE DO NOT GO BACK TO THE RENTAL UNIT! The cleaning and maintenance crews are out during this time. Bring all keys to our office in the packet provided.  Should you check out before we open, there is a box out side our office door where you can leave the keys. If  there is an item missing when the key packet is checked, you will be notified by someone from our office and given the replacement charge. Replacement items must be provided immediately so that future guests can enjoy their vacation.
 
 
Security /Damage Deposit
We require a VISA, MASTERCARD or Discover number on all reservations, in addition to the following:
-$35 Damage waiver fee is charged for all rentals. This only covers accidental damage. Any intetentional or neglegent damage will be charged to your cedit card held for deposit.
-Report any damages within 24 hours of arrival.
-Please remember you are a guest in someone’s vacation home and the home should be treated as such.
 
Family Groups Only
Our properties are rented to families ONLY! This eliminates prom, sorority or fraternity and GROUP PARTIES. Violation of this policy is cause for immediate eviction without refund.
 
Grilling on Decks and Balconies
In the state of North Carolina the Law prohibits grilling on the decks and balconies of rental properties. You may grill only on concrete surfaces away from all wooded surfaces. Should the owner provide you with a grill at the rental home, you are responsible for cleaning it and providing the needed supplies unless otherwise stated.
 
 
 
Pets
We love pets, but MOST RENTAL units do NOT allow pets of any kind. This rule is strictly enforced. There are a few homes that allow pets for an additional charge. Check our brochure or call our office and ask about our pet friendly homes. This fee covers additional cleaning and extermination of the homes (sorry, no cats). Please do not bring a pet into a NON-PET home as many people are allergic and it is unfair to future guests of these homes. ANY PET FOUND ON OR AROUND A NON-PET HOME IS GROUNDS FOR EVICTION, FORFEITURE OF ALL MONIES PAID AND A NON-DECLARED PET FEE OF $100 AT THE SOLE DISCRETION OF CENTURY 21 SCENIC REALTY.
 
Non-Smoking Policy
Smoking is strictly prohibited inside all rental units. Your credit card WILL be charged and you will incur additional charges for carpet cleaning and deodorizing if any evidence of smoking is found.
 
Lock Out Policy
If you are locked out of your unit during business hours, stop by our office to pick up a key. There is a $25 LOCK OUT FEE if someone from our office has to go to the property. 
 
Lost & Found
Century 21 Scenic Realty is NOT responsible for items left. Please take a few moments to look to be sure you have everything. However, should you REQUEST us to locate an item, there is a minimum fee of $25 plus the mailing cost.   Items found are held for 30 days after which they are donated to a local charity.
 
Maintenance
We CANNOT guarantee the operation of all appliances. We make every effort to keep all equipment in working order. If something is NOT working, check the breakers or switches first. All appliances, heat/air units are done on a call-in basis. After hour maintenance problems can be reported by calling (828) 557-9139 ??????? (TENANTS WILL BE BILLED FOR UNNECESSARY SERVICE CALLS).
 
Repairs, Service Calls, Refunds
Agent(s) cannot guarantee against mechanical failure of heating, air conditioning, Hot Tubs, TVs, Satellite Receivers, VCR’s, or other appliances. Please report any inoperative equipment to our office immediately. Agent will make every reasonable effort to have repairs done quickly and efficiently or move Guest(s) to a different property if possible. Should a repairperson make a call to a unit and find that the equipment is in working order and the problem was due to the Guest(s) oversight or neglect, the charge for service will be the Guest(s)
responsibility. No refunds or rent reductions will be made due to failure of appliances or equipment. All maintenance requests must be reported to the office between 9 AM and 5 PM. After 5 PM, a message should be left on office answering machine, if unable to reach agent. Guest(s) understands and agrees that Agent(s) may enter the rental property at any time for the purpose of making needed repairs. Please DO NOT asks for refunds. ~ No refunds for early departures (less days than reserved) ~ No refunds will be given for delayed arrival ~ No refunds for reducing the number of nights reserved with less than 7 days notice ~ No refunds or reschedules due to inclement weather.
 
Property Listed for Sale
Occasionally some of our rental homes may be listed for sale. We appreciate your cooperation in allowing a qualified buyer to look at the property. WE will make every effort to schedule the showing when it is a convenient time and not interrupt your vacation.
 
 
Firewood
Rental Properties are not provided with firewood. It can be obtained from local markets at reasonable rates.
 
 
Alcoholic Beverages
No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) is allowed. Should a Guest(s) or guest of Guest(s) be arrested for underage drinking at the rental unit property or should Agent(s) observe Guest(s) or guest of Guest(s) under the age of 21 drinking alcoholic beverages, this rental agreement may be terminated and the Guests evicted at the option of the Agent(s). Illegal drug use is strictly prohibited. Kegs are not permitted on any property.
 
House Parties
ARE NOT ALLOWED! Occupancy and use of premises shall not be such as to disturb or offend neighbors. The use of firearms, or fireworks is strictly prohibited.
 
Keys
All keys must be returned to agent or left at the property, at time of the check-out. (Guest(s) request how many keys and sign for them) at check-in. As these are privately owned properties, Guest(s) are responsible for lost-keys. The property must be re-keyed in the event that keys are lost, misplaced, or not-returned keys.
 
 
Homes, Furnishings, Equipment, etc.
All homes and condominiums are furnished and equipped by its OWNER. As such, Agent(s) cannot make any changes to the furnishings or equipment provided. Furnishings are subject to change without notice. Under no circumstances are furnishings transferred from one property to another (will result in a charge against Guest(s). MOVING OF FURNITURE IS PROHIBITED. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged against guest’s credit cardt. CERTAIN AREAS IN EACH RENTAL PROPERTY ARE LOCKED, AND ARE NOT INCLUDED IN THIS RENTAL.
 
Linens
A basic supply of linen is provided in each property. Bed linen and bath towels are not changed during your stay.
 
Acts of God/ Construction Noise
Neither Owner nor Agent(s) shall be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather and construction noise from nearby sites. NO REBATE OR REFUND will be offered in these circumstances.
 
Right of Entry
Guest(s) agree that the Agent(s) reserves the right to enter the rental property anytime to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements thereto as Agent(s) may deem appropriate.
 
Expedited Eviction
A material breach of this Agreement by Guest(s), which, in the sole determination of the Agent, results in damage to the Premises, personal injury to Guest(s) or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guest(s) tenancy. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION and forfeiture of rent and security deposit. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Vacation Rental Act will apply. Guest(s) may be evicted under such procedures if Guest(s): (i) hold over in possession after
Guest(s) tenancy has expired; (ii) commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) tenancy; (iii) fail to pay rent as required by this Agreement, or (iv) have obtained possession of the Premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in.
 
Indemnification and Hold Harmless
Guest(s) agree to indemnify and save harmless the Owner and Agent(s) for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). The terms “Agent(s)” and “Owner” as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms
“Guest(s),” “You,” and “Your” as used in this Agreement shall include Guest(s) heirs, successors, assigns, guests, invitees, representatives and other persons on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this Agreement to be upon the rental property), where the context requires or permits.
 
Disputes
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia, and shall be treated as though it were executed in the County of Towns, State of Georgia. Any action relating to this Agreement shall be instituted and prosecuted only in the Towns County Superior Court, Georgia. Guest(s) specifically consent to such jurisdiction and to extraterritorial service of process.
 
Century 21 Scenic Realty
All rental properties are leased without regard to race, color, religion, sex, national origin or handicap.
 
Violating Agreement
If Guest(s) violates any of the conditions of this Agreement; Agent(s) may terminate this Agreement and enter Premises. Upon notice of termination of this Agreement, Guest(s) shall vacate the Premises immediately and forfeit all rents.
 
Credit Card
I am providing my credit card number as a guarantee. I agree to pay all rent and/or any outstanding long distance phone charges, accept all terms of the lease agreement and accept all liability for any damage beyond normal wear and tear during the term of my lease with Century 21 Scenic Realty If I fail to do so I understand that these costs will be charged to my credit card and all credit card sales are final!
